Introduction

  1. The promoter is Auto & General Services Pty Ltd ABN 61 003 617 909, AFSL 241 411  of Level 13, Toowong Tower, 9 Sherwood Road, Toowong 4066, Telephone: (07) 3377 8801 (Promoter) on behalf of the insurer, Auto & General Insurance Company Ltd (ABN 42 111 586 353) (Insurer).
  2. Information on how to qualify forms part of these Terms and Conditions.  Customers who take up the offer are deemed to accept these Terms and Conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions prevail.
  3. Subject to these Terms and Conditions the Promoter is offering customers either a $50 VISA prepaid gift card ($50 Gift Card), or a $150 VISA prepaid gift card ($150 Gift Card),  when they purchase a new Ozicare home and or contents insurance policy from www.ozicare.com.au (Promoter Website) as set out under the heading “Eligibility and Participation” below. For the avoidance of doubt, this promotion is only open to new business customers, not customers renewing their policies with the Promoter (Promotion). For convenience reference to ‘Prepaid Card’ below will mean either the $50 Gift Card or $150 Gift Card.
  4. The Promotion commences on 21 September 2016 at 8:30am and ends at midnight on 31 October 2016 (Promotion Period).  All times are in Australia Eastern Standard Time. Customers are ineligible to participate after the Promotion Period.

    5. Eligibility and Participation

  5. To be eligible for the Promotion, during the Promotion Period, the customer must satisfy all of the following criteria:
    1. Be an Australian resident. Australian resident means a person who resides in Australia at the time of application and either holds Australian or New Zealand citizenship; or holds an Australian permanent residency visa; or has been in Australia continuously for six months or more on a temporary work visa and currently resides in Australia; and
    2. to qualify for the $50 Gift Card, obtain a quote number through the Promoter Website for a new Ozicare Insurance home contents or home building policy; or
    3. to qualify for the $150 Gift Card, obtain a quote number through the Promoter Website for a new Ozicare Insurance home and contents combined policy; and
    4. using the quote number obtained purchase the home and or contents policy mentioned in 5(b) or 5(c) above (each an  Eligible Policy) through the Promoter’s call centre, or the Promoter Website; and
    5. ensure the Eligible Policy is active and valid for a period of not less than 21 days from the date the Eligible Policy is issued (Cooling Off Period).

    6. Privacy

The Promoter is committed to protecting your personal information and agrees to be bound by the Privacy Act 1988 (Cth).The Promoter’s privacy policy is available on the Promoter Website and further details of how the Promoter will collect, store, use and disclose personal information can be found there.
  7. Personal information is collected in connection with entry into this Promotion for the purpose of facilitating access to the Prepaid Card. If the personal information requested is not provided, then a person will be ineligible to participate in this Promotion. By entering into the Promotion, the customer consents to the Promoter disclosing the personal information to the Prepaid Card supplier, and to any of the Promoter’s related entities, using the personal information to process and validate the customer’s claim for the Prepaid Card, and to arrange delivery to the customer (if eligible).

    8. General

  8. Only one Prepaid Card will be issued to the successful Eligible Participant per Eligible Policy. An Eligible Participant is not able to participate in this Promotion more than once.
  9. The Prepaid Card will be posted to the Eligible Participant at the delivery address nominated by the Eligible Participant within 30 calendar days of qualifying for the Prepaid Card.
  10. The Eligible Participant will receive the Prepaid Card with instructions on how it is activated. The Prepaid Card must be activated before it can be used. The instructions will set out how to activate the Prepaid Card.
  11. This Promotion is not available in conjunction with any other promotion or offer, and the Promoter reserves the right to disqualify any person from receiving the Prepaid Card:
    1. If it suspects fraudulent activity; or
    2. for a breach of these Terms and Conditions; or
    3. if it decides the person has not acted in good faith; or
    4. for any false or misleading conduct of any kind.
  12. The Prepaid Card is not reloadable, transferable or exchangeable and cannot be taken as cash. If a Prepaid Card or receipt of it incurs a tax liability, the relevant recipient of the Prepaid Card is liable for payment of such tax.
  13. The Prepaid Card is issued by Heritage Bank Limited (ABN 32 087 652 024) AFSL 240984 Australian Credit Licence 240984. Terms and conditions apply to the Prepaid Card and for details of these and information on how to use the card go to www.ichoosecard.com.au. Eligible Participants agree to be bound by these additional terms and conditions.
  14. The Promoter reserves the right in its sole discretion or subject to any written directions from a regulatory authority, to modify, suspend, terminate, withdraw, or cancel the Promotion at anytime without notice.
  15. If the offer of the Prepaid Card is withdrawn or the Promotion terminated by the Promoter you will only be eligible for the Prepaid Card after the withdrawal or termination date if the offer was applied to your policy while the offer was still in market.
  16. The Promoter reserves the right to request that an Eligible Participant provides supporting documentary evidence of their identity (e.g. driver’s licence, passport, birth certificate) within the Cooling Off Period. If you fail to do so, or the Promoter determines the policy does not meet the eligibility criteria of the offer, you will not be eligible for a Prepaid Card.
  17. The Promoter, (including its officers, employees and agents) will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) including any theft, unauthorised access, third party interference, any technical difficulties or equipment malfunction, or personal injury (including loss of opportunity) suffered or sustained in connection with the Promotion, or the receipt, acceptance, or use of the Prepaid Card (whether negligent or not), except for any liability that cannot be excluded by law.
  18. The Promoter reserves the right to substitute the Prepaid Card with another incentive of the same value.
  19. These Terms and Conditions may be varied at any time without notice.
  20. The offer of the Prepaid Card and any offer of Ozicare Insurance is subject to the Insurer deeming the risk is acceptable in accordance with its underwriting acceptance criteria.
  21. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Queensland. Any dispute arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Queensland.
